Although it is better to take a claim all the way through court if the insurance company is not willing to offer a fair amount, settlement should always be the goal. If a claimant has a good personal injury lawyer who is ready to take his or her claim to trial, the cases will usually be settled short of having to actually go to trial.

The short answer to the question of whether the extent of damage to the victims vehicle makes a difference in the value of the personal injury claim is yes, it does make a big difference, but it should not!
