Hunter Recovers $2 Million for Deer Stand Collapse

The 54 year old hunter suffered a T-1 burst fracture which resulted in paraplegia.
The hunter was sitting in a wooden deer stand and fell when it suddenly collapsed. The hunter fell approximately 30 feet to the ground.
The hunter alleged that the hunting club was careless in failing to properly inspect and maintain the deer stand.

The hunter alleged that the hunting club was careless in failing to properly inspect and maintain the deer stand.
The hunting club, in defense of the claim alleged that the hunter was contributory negligent in failing to properly inspect the deer stand and in failing to wear a safety harness.
In North Carolina contributory negligence is a complete defense in a negligence action. If the case had gone to trial and the jury found that the hunter was even 1% negligent, the hunter would have recovered nothing.
In order to avoid the risk of an adverse outcome each party agreed to settle. Under the terms of this agreement the hunting club paid $2 Million.
At the time of the settlement the hunter had incurred medical expenses of $325,000.00. He will undergo future medical expenses for the rest of his life relating to the fact that he is now a paraplegic.
