One of the most valuable rights we have as citizens of North Carolina and citizens of the United States is the right to a trial by jury. As citizens, we have a right to have twelve impartial and unbiased citizens, who know nothing about our case, to hear the facts and ultimately decide the outcome.
It is good that when important decisions are to be made, citizens do not have to rely upon judges, governmental bureaucrats, or lawyers to decide these important issues. They are decided by an impartial jury made up of ordinary citizens.
Some people fear that if they ask for a jury trial and lose their case, they will have to pay for the cost of the time spent by the twelve jurors during the trial. That is not so.
When a civil action is brought, filing fees must be paid. However, the filing fees cover the expense of a trial by jury and include the judge's time spent in presiding over the case and the necessary paperwork such as motions and other various pleadings.
Once the filing fees are paid, there is no further payment that must be made for the jurors' time or the judge's time in trying the case.
There may be other costs such as the charge for having a sheriff serve a subpoena and the cost of depositions. However, these costs are not paid to the court but instead are paid to the providers of these services.
Therefore, even the smallest cases can be heard in court without fear of incurring high court costs in the even that the case is lost.
