Nightclub may be liable for stabbing outside its premises

A New York, NY man, Jason DeJesus, has filed a novel premises liability law suit against the Roxy, a popular New York City night club, for a stabbing that occurred outside the premises.
His lawyer David Perecman has made the argument that his client was improperly protected by The Beer Garden, Inc., which owns the Roxy, after Mr. DeJesus was stabbed by another club patron a block and a half outside the premises.


According to the suit, the incident occurred when another Roxy patron accosted a friend of Mr. DeJesus while they were still inside the club. The club bouncers removed both people and their friends from the premises, one after the other and all from the same exit. The perpetrator chased after Mr. DeJesus and caught him a block and a half away from the Roxy and proceeded to stab him eight times. Mr. DeJesus has recovered from the wounds he receieved, but he says that he still suffers from psychological trauma and physical pain.
Mr. Perecman made the successful argument that the defendant should have known that harm would come to Mr. DeJesus when both parties were simultaneously removed from the same exit.
